He was sentenced to seven years in a Federal prison but was free on $175,000 bond pending the appeal.He was convicted Sept. 19, 1975, on charges that he and three other persons attached dynamite bombs to four electric transmission towers in the Denver area in 1969 and detonated them as a protest against the Vietnam war.The opinion said that the indictment referred to the towers as war utilities because they helped supply power to a number of defense related industries and facilities in the Denver area. Mr. Bishop was indicted under a 1918 law that outlaws certain conduct when the President has declared a national emergency. The indictment cited a proclamation issued in 1950 by President Truman declaring a national emergency because of the Korean War. The court said that Mr. Bishop could not have been expected to know that the Korean War proclamation was still in effect in 1969 because there could have been doubt about whether the nation was in a “national emergency” in 1969.Thus, the ruling said, Mr. Bishop was not given proper notice that the actions were illegal. His conviction under the 1918 Sabotage Act marked only the third conviction under the Federal statute in peacetime.The United States Attorney's office here said that the decision voided all other charges against Mr. Bishop and that he could not be reindicted. The office added that the Solicitor General's Office in Washington would have to decide in about two weeks whether to carry an appeal to the Supreme Court.
