The Federal Government conducted it at its prison in Milan, since the Michigan constitution prohibited it. Chebatoris and a fellow ex-convict held up a bank in Midland, Michigan. Bank employees thwarted the robbery and the robbers fled. A citizen in a second-floor window shot at their car and it crashed. Chebatoris shot and killed a bystander.
